Protection Claim


This expression is defined by section 82 of the Nationality, Immigration and Asylum Act 2002 as substituted by section 15 of the Immigration Act 2014 with effect from 20 October 2014. It is a claim that removal of the claimant from the United Kingdom would breach the United Kingdom’s obligation under the Refugee Convention or its obligations in relation to persons eligible for a grant of humanitarian protection.
