The Tier 2 Intra company Transfer (ICT) UK immigration route is designed to facilitate the movement of existing workforce within a multinational corporation from their various global locations into the UK.
This sub-category of Tier 2 is particularly useful where companies are looking to transfer knowledge via their highly skilled staff, ensure cultural integration between the various global business units and the UK entity or simply the execution of UK project/contract or part of their wider global talent management and retention strategy.
The process for a UK organisation applying for this sub-category of licence is the same as that for a Tier 2 (General) Sponsor Licence process. The main difference between the two processes is that there is no need to demonstrate that a Resident Labour Market Test has been undertaken.
As part of the Tier 2 (ICT) Sponsor Licence application process the key element is the nature of the relationship with the UK entity and the overseas transferring organisation. UKVI has listed a set of scenarios which they will accept as amounting to an intra-company transfer relationship. The essential ingredient of any such relationship must demonstrate that there is “common ownership & control”.

It is important to note that the Tier 2 ICT, does not lead to settlement (Indefinite Leave to remain). Tier 2 ICT migrants receiving a total salary package of £155,300 or over can remain in the UK for up to 9 years and those earning less than that can only stay for a maximum period of 5 years after which they must return to their home country and be subject to a cooling off period of 12 months.
