Admin Review Frequently Asked Questions

You have made an in-country application under the following routes Tier 1, Tier 2, Tier 4 and Tier 5; and have been refused, you may be able to challenge the decision by way of an administrative review.

Moreso, Point Based System dependants applications are also liable for an admin review.

Your administrative review request must be lodged within fourteen days from the date of the decision. Please note that the general 14 days does not apply to applicants who have been detained. For detained persons, the admin review request should be lodged within seven days.

The UKVI are obligated to reject any Admin review request that is submitted after the deadline. The exception to this general rule, however, is a situation where the Secretary of State is satisfied that it would be unfair to refuse to waive the time limit and it was established that the admin review request was submitted as soon as it was reasonably practicable.

Forward-thinking solicitors/lawyers in this situation would need to demonstrate reasons as to why the Secretary of State should reconsider her decisions. A practical instance may be where an applicant was unable to submit an admin review request as a result of them been rushed to and admitted in a hospital in an emergency for immediate treatment. The migrant must be sure to submit the admin review request as soon as they are physically able to do so.

For an out of the country refusal of a PBS application, the time limit for seeking Administrative Review of a decision of an Entry Clearance Officer (ECO) will be within a twenty eighty calendar period from the date the notice of the decision was received.

If the dependant was a dependant in the initial original application that was refused, then you may include them in the admin review. You may also include a child who was legally included in the application and he or she is over 18 or they have reached the age of 18since the date they were included in the application.
